DMCA and Copyright Policy
Effective November 3, 2026
Nukxon, LLC respects intellectual property rights and expects users to do the same. This policy explains how to report material on Nukxon that infringes your copyright, and how to respond if your material is removed.
Our position
Nukxon hosts 3D scenes and projects uploaded by users. Users are responsible for holding the rights to everything they upload, including third-party 3D models, textures and HDRI environments. Many commercial asset licences permit rendering but prohibit redistribution, and it is the user's responsibility to check.
We remove infringing material when properly notified, and we terminate the accounts of repeat infringers.
Designated agent
Copyright notices must be sent to our designated agent, registered with the US Copyright Office:
Nukxon, LLC
131 Continental Drive, Suite 305
Newark, DE 19713
United States
Notices sent to other addresses may not be processed.
How to file a takedown notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
- Identification of the copyrighted work you claim has been infringed. If multiple works are covered by one notice, a representative list.
- Identification of the material you claim is infringing, with enough detail for us to find it — for a Nukxon project, its full link.
- Your contact details: name, address, telephone number and email.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
Section 512(f) makes it unlawful to knowingly misrepresent that material is infringing. You may be liable for damages, including costs and legal fees, if you do.
What we do when we receive a notice
- We review the notice for completeness. If it is incomplete we will tell you what is missing.
- If it is valid we remove or disable access to the material, typically within 2 business days.
- We notify the user, provide a copy of the notice, and explain how to file a counter-notice.
- We record the complaint against the account for our repeat infringer policy.
Counter-notice
If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice to dmca@nukxon.com containing:
- Your physical or electronic signature.
- Identification of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the district where you live (or, if outside the United States, the District of Delaware), and that you will accept service of process from the person who filed the notice.
If we receive a valid counter-notice we forward it to the complainant. If they do not file a court action within 10 to 14 business days, we may restore the material.
Repeat infringer policy
We maintain a record of copyright complaints per account.
| Complaint | What happens |
|---|---|
| First valid complaint | Material removed, written warning |
| Second | Material removed, account suspended pending acknowledgement |
| Third | Account terminated and Content deleted |
We may terminate sooner in clear cases of deliberate or commercial-scale infringement. Complaints withdrawn or successfully countered are not counted.
A note for users about asset licences
Most infringement on a platform like ours is not deliberate. It comes from misunderstanding what a purchased asset licence allows.
Rendering an asset is usually permitted. Redistributing it usually is not. A Gaussian splat generated from renders is a reconstruction rather than the model itself, which is a materially different thing legally, but it is not a blanket permission. Check your licence before uploading commercial assets, and be especially careful if you intend to make the downloadable files available to others.
If you are unsure, ask the asset vendor in writing. A short email saying yes is worth a great deal if anyone ever queries it.
